What are Optelec's warranty conditions?

OPTELEC US, INC. (“OPTELEC”) warrants its product against defects in material or workmanship for the time periods set forth below when properly used and maintained. Pursuant to this Limited Warranty, OPTELEC will, at its option, (i) repair the product using new or refurbished parts or (ii) replace the product with a new or refurbished product. Minor deviations from specifications that do not affect the performance of the product sold hereunder shall not be deemed to constitute a failure to conform to agreed specifications or a defect material or workmanship. For the purpose of this Limited Warranty, “refurbished” means a product or part that has been returned to its original specifications. This Limited Warranty does not include consumable products that may accompany the product. In the event of a defect, these are your exclusive remedies.

For the periods listed above, from the original purchase date of the product, OPTELEC will, at its option, repair or replace with new or refurbished product or parts, any product or parts determined to be defective.

 

THERE ARE NO OTHER WARRANTIES BEYOND THOSE EXPRESSLY SET FORTH HEREIN. OPTELEC DISCLAIMS ALL OTHER WARRANTIES, GUARANTEES AND LIABILITIES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY. UNDER NO CIRUMSTANCES WILL OPTELEC BE LIABLE TO BUYER OR ANY OTHER PERSON FOR ANY OTHER REMEDIES OR DAMAGES, WHETHER DIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHERWISE.

 

Warranty Exceptions: OPTELEC’s warranty does not cover defect or damage caused by: modification, alteration, repair, or service by anyone other than an authorized OPTELEC service center; abuse or misuse; operation contrary to the instructions provided with it; abnormal operating conditions or events including but not limited to lightning, fire, flood, earthquake, fluctuations or surges of electrical power or Acts of God; damage due to improper packaging or transit by someone other than OPTELEC; or the use of any replacement parts other than those approved by OPTELEC.

 

To obtain warranty service: Notify your authorized distributor or OPTELEC’s Factory Service Center at (800) 444-4443. Once qualified for warranty service, a return authorization and shipping instructions will be given. Any equipment returned to OPTELEC or its authorized service centers must be returned in the original shipping container(s) or replacement containers obtained from OPTELEC. The Individual User will be responsible for all costs associated with returning any product for warranty service; OPTELEC will be responsible for the cost of shipping the remedied product to the Individual User.

 

Any parts or product replaced under this Limited Warranty will become the property of OPTELEC. This Limited Warranty is only valid in the United States. Some states do not allow the exclusion or limitation of consequential damages, or allow limitations on how long an implied warranty lasts, so these limitations or exclusions may not apply to you. This Limited Warranty gives you specific legal rights which vary from state to state.
